About MCN Courts

The court system of the Muscogee (Creek) Nation, one of the five tribes forcibly relocated in the infamous 1830's Trail of Tears, is the most progressive Indian court system currently in operation.  The court house is a modern, mound-shaped building reminiscent of the meeting places where pre-Columbian Creeks debated issues of war and peace.  The Court Room is Native American motif with state of the art equipment.  Legal research is done in a law-library that has the ability to retrieve the latest cases electronically, accomplished via the internet, video conferencing, and has an American flag, draped, with an eagle feather.

The Muscogee (Creek) Nation 1974 Constitution continued the 1867 constitutional organization of the executive, legislative, and judicial branches of the government, with distinct separation of power among the three.

The judicial branch consists of a Supreme Court and District Court.  The Supreme Court is the Nation’s highest court with original jurisdiction over challenges to the Constitution of the Muscogee (Creek) Nation, and appellate jurisdiction over cases appealed from the District Court.  The Supreme Court is the final authority on the Constitution and Laws of the Muscogee (Creek) Nation.
